<p>加拿大蒙特利尔一对柬埔寨华裔夫妇Sy Veng Chun和Leng Ky Lech，早前因为替一个毒贩洗钱，金额高达1个亿，被判8年监禁。今年1月，Lech又因没有支付近1千万加元的相关罚款，被法官加判5年监禁。然而，本周二，加拿大假释委员会决定，被加判后仅关押2个月的Leche重新获释。</p>
<p>据法官称，这是魁省史上最大洗钱案之一，也是加拿大史上最繁杂的刑事案之一。</p>

<p>Chun和Leche现年分别为70岁和55岁，来自柬埔寨，早前在蒙特利尔唐人街经营一间货币兑换所A&amp;A Services mon&eacute;taires inc.。</p>
<p>他们同时通过另外一间公司Peng Heng Or/Gold inc.销售首饰和宝石，但这间公司私下为拥有毒品帝国的走私贩Daniel Muir洗钱。</p>
<p>2004年，Daniel Muir在蒙特利尔市区被杀，夫妇两人卷入警方的调查。</p>
<p>最开始，Chun在蒙特利尔杜鲁多国际机场的行李被截获，警方在行李箱中发现60万加元的现金。之后的调查发现，这对夫妇为Muir的贩毒团伙洗钱已经超过1亿加元。</p>
<p>这起<a class="mykeyword" title="搜索本站有关 案件 的更多信息" href="http://info.51.ca/keyword/%E6%A1%88%E4%BB%B6/" target="_blank" rel="noopener">案件</a>拖了数年，直到2014年，Lech和Chun在蒙特利尔法庭上被定罪。</p>
<p>2015年3月，魁省法庭法官Patrick Healy作出量刑裁决，判处Lech与其丈夫Chun服刑8年。同时，法官Healy还下令这对夫妇在两年限期内，即2017年3月18日之前，支付罚款上千万元，否则他们会在8年刑期的基础上追加5年刑期。</p>
<p><strong>判决的相关数字：</strong></p>

<li>这对夫妇被没收的资产，包括位于Saint-Hilaire的一栋豪宅、位于Saint-Laurent的一栋房屋、价值大约100万加元的珠宝、保存在柬埔寨银行的股票，总共为500万加元左右。</li>

<p>但是，到了罚款期限2017年3月，这对夫妇没有支付罚金，于是他们的案子重新回到法庭，并在去年展开了一系列聆审。</p>
<p>今年1月30日，魁省法庭法官Manlio Del Negro修正了Healy法官2015年的判刑。</p>
<p>在长长的16页裁决书中，Del Negro法官认定，Healy法官没有说清楚追加的5年刑期是否应该分开执行。Del Negro还裁定，5年刑期与8年刑期应是同时执行。</p>
<p>他也表示，这是&ldquo;加拿大刑事法历史上，同类案件中最错综复杂的一个案例。&rdquo;</p>
<p>Del Negro的裁决书中写道，&ldquo;我认为，Healy法官并没有意图让这对夫妇一旦不支付罚款，把量刑变成13年。本法庭认为，即使法官没有在裁决中具体说明，如果违反交纳罚金则刑期分期执行，那么法庭可以理解为法官的意图是刑期不必分期执行。&rdquo;</p>
<p>这样的裁决在执行过程中，又变得更加复杂。</p>
<p>今年1月Del Negro法官作出新的裁决时，Lech与Chun夫妇已经获得假释。</p>
<p>也就是说，假释委员会比法官更早决定让Lech获得自由。当时，Lech已经获准在今年9月全面获假释。</p>
<p>但是因为Del Negro对裁决有新的解释，假释委员会批准Lech于9月获释的决定，就需要把追加的5年刑期考虑进去。</p>
<p>于是，在Del Negro法官作出裁决的第二天，Lech的假释就被暂停，她又重新被送进监狱。</p>
<p>不过在两个月后，假释委员会又重新批准Lech假释。</p>
<p>假释委员会在本周二的声明中说，&ldquo;法庭并没有新的判刑&hellip;&hellip;经过分析，委员会相信你在刑期期满之前不会再犯，因而取消暂停假释。&rdquo;</p>
<p>也就是说，追加的5年期刑，在Lech身上变成了只有2个月。</p>
