枫下茶话 / 美国话题 / I want to get the waiver. My sponsor told me that they have policy to say NO to all waiver. But nobody told me that policy before I am coming. It is cheating!!! Can I appeal it? Thanks.

谈不上欺骗。J类签证有返回原居地服务两年的限制是实行多年并且至今没有很大改变的公开信息。

No. I am not mean "two year residency" policy. I know that. And what I know is I can apply for waiver. I mean they have not told me that they do not support any waiver at all!!!

I accept this internship base on I know I can apply for the waiver for the 2 year residency requirement. If they told me that they have policy to say NO to all waivers, then I will not accept the intern!!!

It is not about "two year residency" policy per se. They should tell us that if we receive funding from US governement, then we cannot receive the waiver at all. We have the right to get informed before coming!!!

They can say: It is cheating too! They can say: We gave you this internship base on we knew you could accept for the 2-year residency requirement. If you told us that you would like to apply for the waiver for the 2-year residency requirement, then we would not give you the intern! They can say: It is cheating!

Everthing is changing. My husband is sent by his firm to their American branch in July (after my accepting the intern). Then we start to think to move to US. Then I start to look for jobs and got one. They cannot say I am cheating.

You can not claim that. You knew the consequences when you accepted the offer. Your sponser now felt that they are used as a jump board. How can they approve you.

It is not necessary for me to take them as a "jump board" at all because from Canada to US is not a big deal. It will be much easier for me to live with my husband and work in US if I have not taken this intern. It is awrong decision. Before coming, they even implied that if I already lived in Canada, 2 years' rule will not apply for me. I still have their email.

Yes. My sponsor is US governmental agency. I really hope it is not. You know, it is only $2400 from US part. My suggestion is do not accept any J1 involved in any amount of US money!!!

I mean, only the DOS has the right, not your sponsor. The DOS requires such a sponsor's view for each applicant? or just for US funding agency? J-1 really make people's life miserable.
